政制發展意見調查 邀請ICT業界發表意見
政府的政改諮詢已進行了數月，普選的具體方案仍有賴各位踴躍提出你的看法，向政府顯示民意。我希望諮詢業界的意見，就此我的辦事處準備了一份政制發展意見調查。為了如實反映受訪者意見，問卷內容包括(一) 有關普選的原則和價值；(二) 2017行政長官產生辦法；(三) 2016立法會產生辦法，及(四) 受訪者的背景資料。本問卷採匿名方式，所有個人資料和回答內容絕對保密，僅作整體統計分析。我們將會整理結果，並向特區政府反映。

另一方面，承接去年二月我在立法會會議上提出有關政府要求互聯網服務供應商公開或移除用戶資料的質詢，今日的立法會會議上我再次提出相近的書面質詢，可惜所獲答覆未能令人滿意。
據政府資料，由2013年2月至今，政府部門向各類互聯網服務供應商/網絡平台/網站等提出至少5507次披露其用戶資料要求，涉及5541個帳戶。各部門中以警務處最多（共4557次，目的為防止及偵查科技或使用互聯網的罪案），其次為海關（共873次，目的為防止及偵查罪案）和通訊事務管理局辦公室（70項，目的為非應邀電子訊息相關調查）
政府部門亦提出至少1955次移除用戶資料要求，涉及558個帳戶。當中絕大部分為衛生署要求移除拍賣受管制/未註冊藥物或中成藥和海關對侵權執法。可惜，政府拒絕公開和檢討現行政策，對我的要求視若無睹。當局應公開目前機制及自行定期公佈數據，提高透明度。

Opinion Survey on Constitutional Development for ICT Sector
The consultation on constitutional development has started for a few months. Your voice matter in formulating the methods for universal suffrage, and I would like to consult the ICT sector and convey your views to the government. My office has prepared an opinion survey on Constitutional Development. The survey comprises four parts, (I) principles and values relating to universal suffrage, (II) methods for selecting the Chief Executive in 2017, (III) methods for forming the Legislative Council in 2016, and (IV) demographic information. Also, following my written question on request Internet service providers for disclosure or removal of users’ information by the Government in February last year, I raised a similar question in the Council Meeting today, but the reply was disappointing.
From the data released, since February 2013 government departments had made at least 5,507 requests to internet service providers for disclosure of users’ information, involving 5,541 accounts. The Police Force made the most requests (4,557 times, for crime prevention and detection of internet crime), followed by Customs and Excise Department (873 times, for crime prevention and detection), and the Office of the Communications Authority made 70 requests for unsolicited electronic messages investigation.
Government departments also made at least 1,955 content removal requests, involving 558 users. Most of the requests were made by the Department of Health in curbing suspected auction or sale of unregistered proprietary Chinese medicine, and the Customs and Excise Department taking action against copyright infringement. Unfortunately, the Government refused to disclose the data regularly and review existing practices. They should make public the mechanisms currently in place for monitoring requests made to ISPs and improve transparency.
