各位IT界朋友:

聯署抵抗網絡惡法 廣募IT政策建議

業界一直關注的創新及科技局,日前在大會上通過議案轉移相關權力,距離新局正式成立又近一步,但仍待財務委員會通過撥款。現時財委會議程仍有不少具爭議的撥款建議,所以目前難以估算新局何時才能真正成立。

另外,最近有網民被指涉嫌在討論區召集網友到旺角參與集會,被警方以「有犯罪或不誠實意圖而取用電腦」罪名拘捕,一時之間人心惶惶,擔心會因網上言論而招致刑責。我特別關注執法部門濫用這條例打擊網絡言論,對網民來說,這稱得上是網絡白色恐怖和對網絡言論自由的一大威脅。(詳情請閱我在10月27日信報專欄的文章

這罪行的門檻是只要證明曾經取用電腦和有「犯罪意圖」警方已可採取行動,我擔心若被濫用,有機會以言入罪和秋後算帳。我就任議員以來,多次向當局跟進和要求檢討,始終不得要領。我已再次去信保安事務委員會要求討論,並在日前發起網上簽名運動,要求政府停止濫用、立即檢討「有犯罪或不誠實意圖而取用電腦」,極需要各位IT界朋友支持,為保障網上言論自由出一份力。

我正在預備遞交給政府有關施政報告和財政預算案的建議書,並會一直在立法會向政府提出質詢,向政府表達業界及社會的訴求和爭取各項支持措施。如你有任何意見,歡迎提出,我的團隊會認真處理和跟進,歡迎各位到此寫下你的意見。

Dear IT friends,

Petition to Protect Online Speech; Call for Ideas for ICT Policy

The motion to establish the Innovation and Technology Bureau was passed in the Legislative Council Meeting earlier this week, bringing us a step closer to the re-establishment of a technology related bureau in Hong Kong. But the final establishment is still pending on the passage of funding from the Finance Committee, and with the backlog of controversial items in the FC, it is still difficult to predict when the new bureau can be set up.

Separately, a netizen was recently arrested for posting messages on an online forum calling others to assemble in Mongkok, on a charge under the offence of "access to computer with criminal or dishonest intent". This has caused concerns in the online community, where people fear they will be charged for their speech. I am particularly concerned whether the law enforcement has abused the use of this offence to regulate online speech, which has caused a chilling effect on free online expression. What worries me most is that this prosecution threshold of this offence is merely the access or use of a computer or electronic device, and vaguely defined "criminal or dishonest intent," making it easy to be abused. Since I joined Legco, I have pursued this issue with the Security Bureau for many times but was only responded with only limited information about these cases. I have further written to Legco's Security Panel to demand to discuss this matter in future meetings. And I also just started an online signature drive to demand the government to stop any abuse of the use of this offence, and an urgent review of the offence of "access to computer with criminal or dishonest intent." I need your support to help safeguard our online freedom of speech and expression.

I am preparing to submit our proposal to the government for its upcoming Policy Address and Budget, and also I am using all opportunities in Legco to ask Council Questions to government. I welcome your views and suggestions, and my team and I will follow up. Please send us your views here.
