關注互聯網中介責任 誠邀研討金融科技
今次想向各位匯報我正參與的法案審議工作,以及對於多條法例草案隱含可能影響互聯網服務供應商或向中介者施加法律責任條文的關注,包括《電子健康紀錄互通系統條例草案》、《2015年結算及交收系統(修訂)條例草案》、《2015年人類生殖科技(修訂)條例草案》。當中都有若干條文提及對提供互聯網服務或以科技協助一些被視作違法的行為會負上法律責任。
然而,官員對我追問何種業務可能違法卻模糊不清,令人憂慮業界朋友若未有留意最新的法例,將來例如為違法者提供網絡服務都可能觸犯法例。我十分關注越來越多的法律將引入向互聯網中介者施加刑責的條文,並擔心會成為趨勢。為此我預備了相關資料簡介,請按此詳閱。在不同的委員會上,我再三敦促當局必須提供清晰合理的書面解釋,釐清各條例的適用情況,避免產生灰色地帶。
「如何克服發展金融科技的挑戰」研討會
政府近來成立推動本港金融科技發展,我認為當局在提供資助和誘因之餘,應研究如何改革規管制度,應對金融科技的迅速發展。我將與梁繼昌議員於5月5日(星期二)晚上舉辦「如何克服發展金融科技的挑戰」研討會(英語討論),邀請到多位重量級講者包括群眾集資、網上借貸、比特幣等的專家、創業家和法律學者,探討法例和規管應如何發展以助本港發展金融科技。有興趣的朋友不容錯過,座位有限,請即按此報名!

Concern over ISP liability in draft bills; Join FinTech seminar on 5 May
In this issue I would like to give you an update of my work in several Bills Committees and share my concern towards a trend of adding ISP liabilities into these laws. A number of Bills such as Electronic Health Record Sharing System Bill, Clearing and Settlement Systems (Amendment) Bill 2015, Human Reproductive Technology (Amendment) Bill 2015 includes clauses that places liability on internet service providers or intermediaries that facilitate behaviour deemed unlawful using technological means.
Officials’ response to my request for clarification were confusing and of little help in understanding the circumstances in which ISPs might face the risk of violating the law. I am worried with uncertainty in some provisions, it is possible that Internet Service Providers (ISPs) and even website designers could offend the law without an intention to do so such as by providing internet related or support services for illegal purposes. My concern is the government increasingly include liability for intermediaries in new legislations which might be established as a habitual practice. I have prepared a summary for those of you who are interested, please read it here. In various meetings I am urging the government to provide a clear and reasonable explanation over the definition and scope of these provisions for avoidance of doubt.
