各位朋友：
促請檢討第161條 關注電視公平競爭
上週立法會保安事務委員會應我去年的書面要求，討論刑事罪行條例第161條「有犯罪或不誠實意圖而取用電腦罪」的適用範圍，不過官員的回應依然令人失望，拒絕正視條文本身的缺陷。即使法庭的判決要尊重，但當局卻不斷提出起訴，測試法庭的反應，繼續濫用這條「網絡萬能Key」。幸好經過我們與關注人士的連串跟進行動，條例的弊端總算獲得公眾的關注。我希望最終能促成第161條的檢討工作，保障市民免受無理檢控。
至於本週立法會資訊科技及廣播事務委員會應單仲偕議員、何秀蘭議員和我的聯署要求，就亞視結業後的頻譜分配安排在該委員會上討論。焦點落於如何分配港台接手後，剩餘的1.5條數碼頻道。當局表示持牌機構才合資格申請頻譜，但因多個機構的申請一直受阻，令人關注市場擁有最多頻譜的機構會否乘機得到更多的頻譜，以致香港電視市場被壟斷的情況持續，甚至惡化。我會繼續關注當局在發牌和指配頻譜的決定，希望當局能確保免費電視的公平競爭。
最後，本週立法會會議上，我就一項促請當局加速推動香港成為金融科技中心的議員議案提出的修正案獲得通過，修正案內容建議當局提供合適的投資環境、稅制、規管制度、基建和人才培訓，以達至以上目的。我亦於發言中引述業界對金融科技的不同觀點，感興趣的朋友歡迎按此收看我的發言片段。

Review Section 161 of Crime Ordinance, and
Fair competition of domestic free TV
Last week in the Panel on Security there was a heated debate on the scope of application of section 161 in the Crimes Ordinance concerning access to computer with criminal or dishonest intent. It was however very disappointing that the administration still refused to review and amend this flawed section. With due respect to the court’s judgements, we question the administration’s use of section 161 to over-prosecute, making S161 a de facto ‘Internet Article 23’ or worse. The problematic aspect of the section is finally drawing public attention. I hope that S161 can be comprehensively reviewed to free innocent computer users from the threat of unreasonable prosecution.
This week, as requested by Hon Cyd Ho, Hon Sin Chung-kai and me in a joint letter, the Panel on Information Technology and Broadcasting discussed the assignment of broadcasting spectrum to be vacated by ATV following expiry of its domestic free television programme service licence, focusing on how the 1.5 digital multiplexes should be distributed. While the Communications Authority states that spectrum can only be assigned to licensed operators, the applications of several companies are still pending. What I do not want to see is more spectrum being assigned to dominant incumbent, thereby worsening the television market competition in Hong Kong. I will keep a close eye on free television licensing and spectrum assignment decisions made by the ExCo and OFCA to ensure fair competition in free television programme services.
Finally, I moved an amendment in Council Meeting this week urging the government to expedite the promotion of Hong Kong's development into a financial technology hub, by including the provision of appropriate investment environment, tax regime, regulatory system, infrastructure and manpower training to encourage market competition and attract talents.
